On January 12, 2023, I wrote to Svea: Brandenburg_to_Svea_2023-01-12.pdf "PESA has the URL https://pesa-court.org and this domain is owned by Villa Europa, which in turn is owned by Krzysztof Sienicki, the same person that is suing me." I provided a screenshot from "https://who.is/whois/pesa-court.org" which states "Registrant Contact Information: Organization Villa Europa Sp. z o.o." It also says "Expires On 2023-09-28", "Registered On 2021-09-28", and "Updated On 2022-08-13". From: Axel Brandenburg To: karol.nowak@jur.lu.se Cc: Bcc: Subject: regarding thesis by Martin Linder and the Latvian arbitration court Reply-To: Dear Karol Nowak, I was looking at the thesis by Martin Linder of 2019, which you supervised, see https://lup.lub.lu.se/luur/download?func=downloadFile&recordOId=8976681&fileOId=8979960 On page 10, end of Sec 2.3.3, under "Ogiltighet på grund av svensk public policy", he talks about the case with a Latvian arbitration court. Do you know more about this, or could you put me in touch with people who do? The background of my email is this. I have a potentially similar and even more striking case. Svea Hovratt tries to enforce an arbitration award from the "Pan-Europejski-Sad-Arbitrazowy (PESA)", https://pesa-court.org, but this domain is owned by Villa Europa (see https://who.is/whois/pesa-court.org) which in turn is owned by Krzysztof Sienicki, the same person that is suing me. Should this not fall under "Ogiltighet på grund av svensk public policy"? I wrote about this to Svea Hovratt on January 12, and they advised me by phone to get legal assistance, which I have. My main concern is one of principle and may require a change of handling arbitration awards in Sweden. The case in question involves 34 people in Europe (likely up to 110), of which 11 are in Sweden. One person (Chinese national in Gavle) did apparently not react to Svea Hovratt's letter, and Kronofogden enforced 80,100 SEK payment, after an unsuccessful (probably unprofessional) appeal. Sorry for not having introduced myself. I am a professor of physics in Stockholm, https://www.nordita.org/~brandenb/ As all the European victims, I also lectured via zoom at an event in 2020 that was 1.5 years later associated with Villa Europa. One more concern is that Svea Hovratt may "naively" write back to PESA without appreciating that this is not a court, but a one-man operation by Sienicki, and may thus provide ample warning before Polish authorities can make him pay back.
