Date: Sat, 17 Jun 2023 22:40:02 +0200 From: Axel Brandenburg To: Mattias Carlsson CC: Michele Catanzaro Subject: Re: Svea hovrätt reacting on alleged arbitrational awards Dear Mattias Carlsson (cc Michele Catanzaro), I emailed you on May 31 about a sensitive story to come out in Nature, but this story by Michele Catanzaro (cc) is being delayed for unclear reasons and now Michele gave me his ok that I tell you details. The information with the courts is public anyway, and maybe you have already made use of that. Remarkably, since earlier in the week, we know of a 5th case in a third country: Spain. There is now no reason that other known cases in Italy, Slovenia, and the Netherlands can turn into expensive court cases as well. Let me begin with the 5 known court cases, which all involve PESA, which I mentioned in my email of May 31: Ö 12191-22 Svea Hovratt: Axel Brandenburg; my own case Ö 11558-2 Svea Hovratt: Henrik Hult Ö 4652-22 Svea Hovratt: Björn Johansson 12 Sch 12/22 Kammergericht (Berlin): Kai Nagel 26/2023 Sala de lo Civil y Penal del Tribunal Superior de Justicia de Madrid: Victoria Lopez All those cases were initiated by Krzysztof Sienicki from Poland (details below) asking these courts to enforce an arbitration award from the "Pan-Europejski-Sad-Arbitrazowy (PESA)", https://pesa-court.org, but this domain is owned by Villa Europa (VE), which in turn is owned by Krzysztof Sienicki; see https://who.is/whois/pesa-court.org for registration details. The relevant documents are with the respective courts and public. I have collected my own material here: http://norlx65.nordita.org/~brandenb/VE/ The lawyers in all cases have pointed out that Sienicki has submitted falsified documents to the courts. The latest summary of the case is given in the closing documents provided by my lawyers; see http://norlx65.nordita.org/~brandenb/VE/2023-05-25/Yttrande_12191-22.pdf which has so far led to 281,000 SEK just in my case alone! All of this could perhaps have been *avoided* if the Swedish Court had been alarmed by my early letter of January 12, 2023: http://norlx65.nordita.org/~brandenb/VE/2023-01-12/Brandenburg_to_Svea_2023-01-12.pdf Lina Wogel called me the following day. She was clearly not concerned when I emphasized that the website of PESA was registered by Sienicki himself. She said I need to prove this and recommended that I get legal assistance. It appears that there is *no* reality check at the courts. This invites criminals to produce falsified documents with those courts, because the legal hurdles to pursue them abroad are high. (I have case numbers PG 372-23 and PP PL 129+23 with the Polish police, but they don't speak English and are not working actively on the case.) My concern is therefore one of principle and may require a change of handling arbitration awards. I have been in touch with a lawyer in Poland, Dr Piotr Łebek who is familiar with this case and is an expert in arbitration. He is working on bringing this case to the state attorney in Poland because of the high level and publicity associated with this case of organized crime. He also understands that it is impossible for me to justify paying him for a job that is really in the interest of so many others. Please take a look at http://norlx65.nordita.org/~brandenb/VE/ where you find lots of detail. In particular, http://norlx65.nordita.org/~brandenb/VE/2023-04-24/Reopened_2023-05-24.pdf which shows that the Swedish prosecutor has reopened the case after it has initially closed its investigate of my report of February 13; which you also find in my Villa Europa (VE) files. Let me know if we want to talk with me. My mobile is +46 73 270 4376, although I prefer zoom or other such means of communication.
